Terms of Service for LoadLink Africa
1. Introduction
These Terms of Service (“Terms”) govern your use of the LoadLink Africa mobile application and website (“Services”), jointly provided by Nile IT Technology LLC (USA) and its licensed partner in South Africa (“we”, “us”, or “our”). By accessing or using our Services, you agree to these Terms and our Privacy Policy.
2. Eligibility
- To use our Services, you must be at least 18 years old and capable of forming a binding contract. By using LoadLink Africa, you confirm that you meet this requirement.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when registering as a Trucker or Shipper.
4. Use of Services
- Violate any applicable laws or regulations;
- Upload false documents or misleading information;
- Infringe the rights of others, including privacy or intellectual property rights.
5. Trucker and Shipper Responsibilities
- Truckers must provide valid documentation (license, insurance, vehicle registration).
- Shippers must ensure the accuracy of shipment details.
- Both parties must comply with the terms of each transaction and act in good faith.
6. Payment and Fees
LoadLink Africa may charge service fees, which will be disclosed prior to any transaction. You agree to pay all applicable charges associated with your use of the Services.
7. Intellectual Property
All content, trademarks, logos, and software on LoadLink Africa are owned or licensed by us. You may not use them without our written permission.
8. Termination
- We reserve the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, if we believe you have violated these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, LoadLink Africa shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa and the State of California, without regard to conflict of law principles.
11. Dispute Resolution
In the event of a dispute, parties agree to seek resolution through amicable negotiations. If unresolved, disputes shall be subject to the jurisdiction of competent courts in South Africa or California.
