1. CORPORATE STRUCTURE & OWNERSHIP
LoadLink Africa is a proprietary logistics technology platform fully owned by Nile IT Technology LLC, a California Limited Liability Company (United States).
Local operational activities within the Republic of Kenya are conducted in partnership with Eventive Tigani Limited, a registered company in Nairobi, Kenya.
Nile IT Technology LLC retains exclusive ownership of all intellectual property, including source code, backend infrastructure, databases, APIs, branding, and trademarks.
2. STRATEGIC PARTNERSHIP STRUCTURE
Eventive Tigani Limited acts as the exclusive local operational partner within Kenya. Its responsibilities include driver onboarding, local compliance facilitation, customer support, and operational coordination.
Technical governance, data security oversight, cloud hosting, system architecture, and product control remain under Nile IT Technology LLC.
3. DATA CONTROLLER & PROCESSOR IDENTIFICATION

Eventive Tigani Limited (Nairobi, Kenya)
4. PRIVACY POLICY (APPLE & GOOGLE COMPLIANT)
4.1 Data Collected
– Account Information (name, phone number, email)
– Driver verification data (where applicable)
– Transaction & shipment records
– Device identifiers & app logs
– Location data (only while actively using service features)
4.2 Purpose of Processing
Personal data is processed solely for logistics service delivery, route optimization, fraud prevention, safety monitoring, customer support, regulatory compliance, and performance analytics.
4.3 Apple App Tracking Transparency
The application requests location and notification permissions consistent with Apple’s App Tracking Transparency (ATT) framework. No third-party advertising tracking is conducted without user consent.
4.4 Data Sharing
Personal data is not sold. Data may be shared with service providers (cloud hosting, communications tools), drivers/customers to complete transactions, or legal authorities when required by law.
4.5 Cross-Border Data Transfers
Data collected within Kenya may be securely processed and stored on U.S.-based cloud infrastructure managed by Nile IT Technology LLC. Industry-standard encryption (TLS 1.2+) and access controls are applied.
4.6 Data Retention
Personal data is retained only as long as necessary to fulfill operational, legal, tax, and dispute-resolution obligations.
4.7 Account Deletion (Apple Requirement)
Users may request permanent deletion of their account through in-app settings or by contacting support. Requests are processed within applicable legal timeframes.
5. DATA PROCESSING FRAMEWORK (DPA SUMMARY)
The Parties comply with the Kenya Data Protection Act 2019 and applicable U.S. data protection standards. Eventive Tigani Limited processes personal data strictly under the documented instructions of Nile IT Technology LLC.
Security safeguards include encryption, role-based access controls, secure document handling, incident monitoring, and breach notification procedures.
6. SECURITY & SAFEGUARDS
LoadLink Africa maintains administrative, technical, and organizational safeguards including encrypted communications, secure hosting infrastructure, access control management, monitoring systems, and internal compliance procedures.
7. LIMITATION OF LIABILITY
Neither party shall be liable for indirect or consequential damages. Liability is limited to the maximum extent permitted by applicable law.
8. GOVERNING LAW
This framework is governed by the laws of the State of California, United States, with operational compliance requirements applicable within Kenya.
9. EXECUTION
This Unified Legal & Compliance Framework is duly authorized and approved by the respective authorized representatives of the Parties and becomes effective as of the Effective Date stated above.
